Upcoming events of TP Consulting.

On 10 December 2018, Saudi Arabia’s General Authority of Zakat and Tax (GAZT) published draft transfer pricing by-laws (TP By-laws) for public consultation. The TP By-laws broadly follow international standards, including the arm’s-length principle and documentation standards as set out in the Organisation for Economic Co-operation and Development (OECD) Transfer Pricing Guidelines.

As per the GAZT website, “the TP By-laws are ‎applicable to persons considered taxpayers in Saudi Arabia under the corporate ‎Income Tax Law. Generally, this includes - without limitation - multinational enterprise‎groups (MNE Groups), one or many members of which are deemed a taxable person in Saudi Arabia.”‎

The TP By-laws introduce new compliance requirements for fiscal years ending on or after 31 December 2018, including the submission of a Controlled Transaction Disclosure Form - due within 120 days from the end of the fiscal year end and filed as part of the annual income tax declaration. Additionally the TP By-laws introduce transfer pricing documentation and country-by-country (CbC) reporting requirements that are broadly aligned with the OECD’s Base Erosion and Profit Shifting (BEPS) Action 13 Final Report.

Abir Mukherjee

Director, Transfer Pricing/International Tax (ITS), EY

Abir has experience in many transfer pricing projects, encompassing transfer pricing planning, compliance, and contemporaneous documentation for intangible property, intercompany services and financial transactions for clients in diverse range of industries, including pharmaceutical, oil & gas, investment advisory and FMCG. He has been involved in debt restructuring, cost allocation, assignments which included the cost of debt analysis for one of the oil & gas majors of the world as well as merger & acquisition related international transactions in the investment advisory and pharmaceutical sectors.  He has also assisted clients in negotiating APA and has successfully negotiated one of the first APA’s in India. Abir has also been involved in transfer pricing compliance and litigation for several clients as well as preparing transfer pricing manuals for clients’ to assist the finance managers to implement the transfer pricing policy within the organization

TP Consulting´s founder and partner (transfer pricing specialized network, with offices in 30 countries). MBA from ESAN University. Lawyer by the Pontifical Catholic University of Peru, with specialized studies in Tax Law at this University. Postgraduate Professor of the Transfer Pricing course at the ESAN University (Peru - since 2002). He had been a visiting professor of the Transfer Pricing course at the University of Leiden (International Tax Center - Netherlands). Co-author and coordinator of the books: "Transfer Pricing in Iberoamerica, USA and United Kingdom" (Thomson Reuters, 2019 and 2018), "Transfer Pricing in Iberoamerica" (Thomson Reuters, 2017) and "Transfer Pricing in Latin America" (Thomson Reuters, 2016).
